The present writ petition has been filed on behalf of the

petitioner with the following prayers:-

“i) Direct the respondents to issue income and asset certificate and economically weaker section Certificate procedure prescribed for issuance of EWS Certificate and after ascertaining the income of the family of the petitioner; ii) In alternate, Direct the respondents to issue OBC certificate for reservation in the state of Rajasthan for direct Recruitment in civil Posts And services iii) Any other relief as this Hon’ble Court may deem fit and proper be also passed in favour of the petitioner.”

Mr. V.D. Ghathala, Assistant Government Counsel appears

and accepts notice on behalf of all the respondents.

that the issue involved in the present writ petition has already

been decided by a Co-ordinate Bench of this Court vide order dated 07.07.2025 in S.B. Civil Writ Petition No.8203/2025 (Saneh Lata v. State of Rajasthan) .

The relevant portion of the aforesaid order dated 07.07.2025; Saneh Lata (supra) is reproduced as below:-

“ In view of above, this writ petition is also disposed of in light of the order passed in the case of Sunita Kumari (supra). The petitioner is directed to make an application before the concerned Sub Divisional Magistrate, who shall carry out the necessary enquiry as required under the law and if petitioner is found entitled for EWS certificate, same maybe issued through offline/online mode within a period of one month from the date of receipt of the application. The Competent Authority is required to look into the entitlement of the candidate for the purpose of issuing certificate in EWS category and this certificate is not in relation to any caste or category. This Court also makes it clear that the observations of this Court in respect of grant of EWS certificate, will not have any bearing on entitlement of the petitioner to get benefit except that issuance of certificate will be in pursuance of circular issued by the State Government. ”

In light of the above, the present writ petition is disposed of in the same terms, as reproduced above, as issued in the case of Saneh Lata (supra).
