Instant Writ Petition is preferred by petitioners with following

prayer:-

(i) direct the respondents not to give compassionate appointment to the respondent No.3 (Anita, the wife of the deceased) as she left her matrimonial home immediately after the death of their deceased son and not fulfilling the responsibilities towards her old aged inlaws.

(ii) direct the respondent No.1 looking to the fact and circumstances of the case to give compassionate appointment to the elder son Naveen of the deceased employee, after attaining the age of majority, who is now about 14 years of age.

(iii) direct the respondents to give appropriate share of all the monetary benefits of service of their deceased son, so that they could live their life.

(iv) direct the respondent No.2 bank to release the appropriate share of all the amount of monetary benefits of service of their deceased son.

(v) direct the respondents No.1 and 2 to deduct the appropriate amount to the petitioners for their livelihood from the salary of the person taking the compassionate appointment, family pension, monetary benefits etc of service of the deceased.

During course of arguments, learned counsel for petitioners submits that son of present petitioner expired on 24.05.2025 and after his death respondent No.3 is claiming entire benefit from respondent No.1 (employer). He further submits that they have submitted a representation but same has not been considered.

Considered the grievance raised herein, the petitioners are given a liberty to submit a representation to respondent No.1 within a period of two weeks raising all grounds. The respondent No.1 is directed to dispose of the representation with a reasoned and speaking order within a period of 4 weeks from date of receipt of representation. After passing the order, the respondent is under an obligation to communicate the order to the petitioner either by way of speed post or through E-mail, if petitioners have provided E-mail in his representation. If the petitioners are still aggrieved, they may re-approach the court with fresh petition.
