By way of filing this writ petition, a challenge has been led to the impugned communication letter dated 27.05.2019 issued by respondent-Central Board of Secondary Education (for short “CBSE”) to the Principal of the School by which the request letter sent by the school with regard to correction in the names of the petitioner and his parents in his mark-sheet, Examination certificate and migration certificate of Class-10^th has been rejected.

By way of filing this writ petition, a prayer has been made by the petitioner for issuing directions to the respondents to make correction in the name of the petitioner and his parents in the

mark-sheet, examination certificate and migration certificate of Class-10^th .

It appears that before approaching this Court, the same request was made by the petitioner before the concerned school to send a letter to the respondent-CBSE for doing the needful, but the respondent-CBSE has refused to pass appropriate orders and rejected the prayer made by the school with regard to the aforesaid purpose.

Perusal of the impugned letter dated 27.05.2019 issued by respondent-CBSE indicates that no cogent reason has been assigned and no speaking order has been passed vide the aforesaid impugned letter. 5. In the considered opinion of this Court, the respondent-CBSE is supposed to pass a reasoned and speaking order assigning reasons for not entertaining the application submitted by the petitioner’s school.

On this count alone, the instant writ petition stands disposed of by issuing directions to the respondent-CBSE to decide the matter afresh by passing a reasoned and speaking order expeditiously as early as possible preferably within a period of four months from the date of receipt of certified copy of this order. 7. Stay application as well as all applications (pending, if any) also stand disposed of.

The petitioner would be at liberty to submit documents in support of his claim before the respondent-CBSE and it is expected from the respondent-CBSE to consider the same and pass appropriate orders accordingly.
