Learned counsel for the petitioner submits that during the pendency of the instant petition, after investigation, police has submitted negative factual report, learned Public Prosecutor has not controverted the same fact.
In view of above, at this stage, learned counsel for the petitioner does not press the instant petition with liberty to file a fresh petition, in case, need so arises.
Accordingly, the instant petition is dismissed as not pressed with liberty as prayed for.
