These instant bail applications have been filed under Section 483 of BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 22/2025-26 registered at Police Station Excise Prohibition Squad, District Beawar for the offence(s) under Sections 19/54, 54-A of Rajasthan Excise Act

Learned counsels for the accused-petitioners submit that the accused-petitioners have falsely been implicated in this case. The offences alleged to have been committed by the petitioners are triable by Magistrate. They further submitted that the accusedpetitioners are in custody since 20.06.2025 and trial of the case may take considerable time. There are no criminal antecedents against the petitioners, therefore, considering the above facts, these bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor vehemently opposed the bail applications.

Heard and perused the material available on record.

Considering the arguments advanced by learned counsel for the petitioner and looking to the fact that the offences alleged to have been committed by the petitioners are triable by Magistrate. The accused-petitioners are in custody since 20.06.2025 and trial of the case may take considerable time. There are no criminal antecedents against the petitioners. Without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, these bail application under Section 483 of BNSS are allowed and it is ordered that the accused-petitioners namely: 1. Insaf Kathat S/o Shri Vinod Kathat, 2. Aasan S/o Shri Alladin, in connection with FIR No. 22/2025-26 registered at Police Station Excise Prohibition Squad, District Beawar shall be enlarged on bail provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before
