The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.122/2025 registered at Police Station Vishwakarma, District Jaipur (West) for the offence(s) under Sections 318(4) and 316(2) of BNS.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case due to some salary dispute of the petitioner with the complainant. He further submits that prima-facie the offences under Sections 318(4) and 316(2) of BNS is not made out against the petitioner. The matter is exclusively triable by Magistrate. The petitioner is in custody since 29.05.2025 and there are no criminal antecedents

against the petitioner, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application and contended that the accused-petitioner being executive of the company misappropriated an amount of Rs.9,82,123/-, therefore, considering the nature of allegation against the accused-petitioner, the bail application of the accusedpetitioner may be dismissed.

Heard and perused the material available on record.

It is not desirable to express anything on the merits of the case. The charge-sheet against the petitioner has already been produced. The matter is exclusively triable by Magistrate. The accused-petitioner is in custody since 29.05.2025 and there are no criminal antecedents against the petitioner, and the trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Kamlesh Kumar Jhalani Son Of Shri Babulal Jhalani, in connection with FIR No.122/2025 registered at Police Station Vishwakarma, District Jaipur (West) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
