The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 50/2025 registered at Police Station Clock Tower, District Ajmer for the offence(s) under Sections 8/18 of NDPS Act.

Learned counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this case. It is argued that recovery of contraband article-opium was effected from coaccused Hemendra. The recovered quantity of opium is 11.384 KG, which is below commercial quantity. There is no evidence on the record that petitioner alongwith the other coaccused were traveling in a car and thereafter co-accused Hemendra run away from the car. There are no criminal antecedents against the petitioner. The accused petitioners are in

custody since long and the trial of the case will take considerable time, therefore, the benefit of bail may be granted to the accusedpetitioners.

Learned Public Prosecutor opposes the grant of bail application and submitted the factual report. The same is taken on record.

Heard and perused the material available on the record.

Considering the arguments advanced by learned counsel for the petitioner and looking to the fact that recovery of contraband article were effected from co-accused Hemendra and not from the present petitioner. There are no criminal antecedents against the present petitioner. The accused petitioners are in custody since long and the trial of the case will take considerable time without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Bhairulal Dhakad S/o Shri Onkarlal, in connection with FIR No. 50/2025 registered at Police Station Clock Tower, District Ajmer shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
