These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.108/2025 registered at Police Station Bayana, District Bharatpur for the offence(s) under Sections 109(1), 111(2)(b), 190, 191(3), 115(2), 125 and 126(2) of BNS.

Learned counsels for the accused-petitioners submit that the accused-petitioners have falsely been implicated in this case. They further submit that prima-facie, no offences are made out against the accused-petitioners and no injury was ever received by anyone. The case was lodged at the instance of the Police Officials. No fire arm was recovered from the present petitioners. The accused-petitioners are in custody since 04.05.2025 and charge-

sheet against the accused-petitioners has already been submitted, before the concerned Court and further, trial of the case may take considerable time, therefore, these bail applications of the accused-petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the bail applications and contended that apart from the petitioner- Jitendra @ Jitu, all the petitioners are habitual offender and against him, 8 criminal cases are pending, therefore, considering the allegatin levelled in FIR and criminal antecedents of the accusedpetitioners, these bail applications of the accused-petitioners may be dismissed.

Heard and perused the material available on record.

Considering the arguments advanced by learned counsel for the petitioners and looking to the fact that the accused-petitioners are in custody since long and trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accusedpetitioners on bail.

Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely: 1. Devendra @ Deva S/o Dharam Singh, 2. Jitendra @ Jitu S/o Sugar Singh, 3. Nathan S/o Prahlad, 4. Mahesh Kumar S/o Sujan Singh and 5. Ajeet S/o Roshan Lal, in connection with FIR No.108/2025 registered at Police Station Bayana, District Bharatpur, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for

their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.

The accused-petitioners namely 1. Devendra @ Deva, 2. Nathan, 3. Mahesh Kumar and 4. Ajeet, are also directed to mark their presence on 25^th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused-petitioners to the trial court every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the applications against the petitioners for cancellation of the bail before the concerned Court.
