These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 49/2025 registered at Police Station Karvar, District Bundi for the offence(s) under Sections 143(3), 144(1), 98, 99 and 62 of BNS.

Learned counsel for the petitioners submits that the accusedpetitioners have falsely been implicated in this case. He further submits that the statement of the prosecutrix PW-3 "X" has been recorded and in her cross-examination she has specifically stated that petitioner Naresh did not commit any offence with her, in her cross-examination she has also stated that in her police statement Exhibit D-1, it is wrongly written that family members of Naresh snatched her mobile and kept her in confinement. She has also denied that she was sold to petitioner and entered into marriage with petitioner Naresh. It is also contended that with regard to other petitioner Rajesh and Kamlesh prosecutrix has not uttered a single word. In her examination in chief she has only stated that she talked to Rajesh and Kamlesh, who denied to take her to Manish's house. In her examination in chief she has not deposed anything which constitute an offence against petitioner Rajesh and Kamlesh. The accused petitioners are in custody since long and the trial of the case will take considerable time, therefore, the benefit of bail may be granted to the accused-petitioners.

Learned Public Prosecutor has submitted the intimation report served upon the complainant but nobody has put in appearance on behalf of the complainant.

Learned Public Prosecutor opposes the grant of bail applications and submitted the factual report. It is contended that

allegation against the petitioner are grave therefore, the bail application of the accused-petitioner deserves to be dismissed.

Heard and perused the material available on the record.

Considering the arguments advanced by counsel for the parties and without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail application under Section 483 BNSS are allowed and it is ordered that the accused-petitioners Rajesh @ Raju S/o Ramcharan, Naresh S/o Chetram and Kamlesh S/o Shri Sitaram,in connection with FIR No.49/2025 registered at Police Station Karvar, District Bundi shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
