Omprakash Meena S/O Murarilal Vs State of Rajasthan

The present application under Section 482 of B.N.S.S. has been filed by the petitioner apprehending his arrest in connection with FIR No.309/2023 Police Station Bhusawar, District Bharatpur for the offences under Sections 143, 323, 341, 379, 365, 504 & 506 of IPC.

Learned counsel for the petitioner submits that in compliance of the order dated 28.02.2025, the petitioner has joined the investigation. He also submits that the petitioner has not been named in the FIR. Similarly situated co-accused Prabhu has already been enlarged on anticipatory bail by a co-ordinate Bench of this Court on 09.07.2024 and the case against the petitioner is on similar footing to that against the co-accused Prabhu. therefore, prayed that the petitioner may also be enlarged on anticipatory bail.

I have given my thoughtful consideration to the submissions advanced at bar and have gone through material available on record.

Having regard to the facts and circumstances of the case; upon a consideration of the arguments advanced and stating the fact that the similarly situated co-accused Prabhu has already been enlarged on anticipatory bail, this Court is of the opinion that it is a fit case for grant of anticipatory bail to the petitioner under Section 482 of B.N.S.S.

Accordingly, the bail application under Section 482 of B.N.S.S. is allowed and it is directed that in the event of arrest of petitioner - Omprakash Meena S/o Murarilal , in connection with F.I.R. No.309/2023 dated 26.06.2023 registered at Police Station Bhusawar, District Bharatpur, he shall be released on anticipatory bail; provided he furnishes a personal bond in the sum of Rs.50,000/- along with two sureties of Rs.25,000/- each to the satisfaction of the concerned Investigating Officer/S.H.O. on the following conditions :-
