The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.0027/2025 registered at Police Station-Mokhampura, District-Jaipur for the offences under Sections 305(b) and 334(2) BNS, 2023.

Since all these cases arise out of the common F.I.R., they are being decided by this single order.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case on false and concocted grounds. The alleged offences are triable by First Class Magistrate. Learned counsel further submits that though there are recovery of certain laptops from the present petitioners, but that too were after 15 days of the alleged incident. The petitioners are behind the bars since March/April, 2025 and charge-sheet has been filed. Learned counsel for the petitioners again contends that there is no criminal antecedents against accused i.e. Irfan, Bilal, Sakil and Mubarik, though one criminal case of different nature is pending against accused-Sakil, in which he is on bail. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence the bail applications of the petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed these bail applications.

On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

Accordingly, these bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the petitioners -Irfan, Bilal, Rahul, Sakil and Mubarik @ Mubba, shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/-

with two sureties of Rs.25,000/- each to the satisfaction of the learned Trial Court for their appearance before that Court on all the dates till conclusion of the trial.
