The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.0368/2022 registered at Police Station-Pahadi, District-Bharatpur for the offences under Sections 323, 341, 143, 336 of Indian Penal Code, 1860.

Since all these cases arise out of common F.I.R., they are being decided by this single order.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case. Learned counsel further submits that no specific act was attributed to petitioner-Talim, while, there is an allegation against petitioner-Fareed Hussain of causing head injury to injured-Rizwan, but as per the medical report of Rizwan, two injuries have been caused which are simple in nature and about those injuries, no medical opinion about dangerous to life was obtained. Learned counsel further submits that co-accused namely; Aarif, Hamid @ Chaubha and Husaina have already been enlarged on bail by the Co-ordinate Bench of this Court on 29.07.2024. The petitioners are behind the bars since 04.02.2025 and charge-sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence the bail applications of the petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed these bail applications.

On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Accordingly, these bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the petitioners -Talim S/o Dhyani and Fareed Hussain S/o Abdullah shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned Trial Court for their appearance before that Court on all the dates till conclusion of the trial.
