The matter comes upon an interim application filed on behalf of the accused-petitioner for seeking interim bail on the ground of petitioner's mother demise.

It is contended by learned counsel for the petitioner that initially the interim bail application was submitted on the ground of petitioner's mother illness but later on during the pendency of the said application, the mother of the petitioner has died.

Learned Special Public Prosecutor has opposed the interim bail application and submitted the death of the deceased according to the death report, the deceased expired on 07.02.2025, the same is taken on record. It is also contended that the accused-petitioner was already allowed to participate by the trial Court for a period of 6 hours to perform last rites of his

mother under Police Protection and after completion of the said period the petitioner was readmitted by the concerned Jail Superintendent. It is also contended that the matter is fixed for statement of witnesses on 15^th February 2025, 17^th February, 2025 and 18^th February, 2025, therefore, accused-petitioner may be directed to ensure that he would appear before the trial Court on these dates.

Considering the above facts, this Court deems it proper to enlarge the accused-petitioner on interim bail for a period of 15 days from today. The accused-petitioner shall surrender before the concerned Jail Authority on or before completion of 15 days from the date of release.

Accordingly, the application for grant of interim bail of the accused-petitioner-Gaurav Arora S/o Krishan Kumar Arora, is allowed in connection with FIR No.02/2020, registered at Police Station Central Bureau of Narcotics, District Kota, is allowed. The petitioner shall be enlarged on interim bail for a period of 15 days commencing from today i.e. 10.02.2025 on furnishing a personal bond in the sum of Rs.50,000/- and two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court. Needless to say that after availing interim bail, the accusedpetitioner shall surrender before the concerned Jail Authority on or before completion of 15 days from the date of release. The petitioner shall appear before the trial court on the dates fixed for recording of statements of witnesses i.e. 15.02.2025, 17.02.2025 and 18.02.2025.

The concerned Jail Authority is directed to send the report to trial Court regarding surrender of the accused-petitioner.

In case the petitioner fails to comply with the conditions or fails to surrender before the Jail Authority within stipulated time, his bail bonds shall stands forfeited and the proceedings for arresting the accused-petitioner shall be initiated immediately by the trial Court. The trial court shall intimate this Court about surrendering of the petitioner and so also any non-compliance by the petitioner.
