This criminal appeal under Section 14A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter to be referred as 'the SC/ST Act’) has been filed on behalf of the appellant being aggrieved with the order dated 17.09.2025 passed by the learned Special Judge S.C./S.T. (Prevention of Atrocities Cases), Jaipur Metropolitan First (hereinafter to be referred as ‘trial court’) in FIR No. 03/2022 registered at Police Station Pratap Nagar, District Jaipur City (East) for the offence under Sections 143, 452, 323, 341, 354, 504, 506, 307 of IPC and Section 3(1)(R), 3(1)(S), 3(2)(V) of SC/ST Act,

1989 (Amendment 2015) whereby the trial court has dismissed the bail application filed on behalf of the appellant.

Heard the learned counsel for the appellant, learned Public Prosecutor and perused the material on record. 3. Despite information no one is present on behalf of the complainant.

Learned counsel for the appellant submits that the appellant has not been named in the FIR and there is no specific act attributed to the present appellant. He argued that co-accused Shekhar Singh has been granted bail on 04.02.2023 and another co-accused Devendra Singh was enlarged on bail on 07.11.2023. The case of the appellant stands on better footing. The appellant is in custody since 09.09.2025 and charge-sheet has been filed. Therefore, the appeal presented by the present appellant may be allowed.

Learned Public Prosecutor has vehemently opposed the appeal.

Considering the facts and circumstances of the case and without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the appeal filed by the appellants under Section 14-A(2) of SC/ST Act.

Accordingly, this criminal appeal filed under Section 14-A(2) of SC/ST Act is allowed and order dated 17.09.2025 passed by the learned trial court is set aside. It is directed that appellant Babu @ Sonavaj Ali S/o Mohd. Shabbir, shall be released on bail provided he executes a personal bond in a sum of Rs.50,000/with two sound and solvent sureties of Rs.25,000/- each to the
