The matter comes up for consideration of application under Section 5 of the Limitation Act with a prayer to condone the delay of 169 days in filing the present appeal.

Notice of application under Section 5 of the Limitation Act has already been served upon the respondent.

Learned counsel for the respondent has submitted that pursuant to the directions given by the learned Single Judge vide

impugned order dated 03.11.2011, the requisite payment has already been made to the respondent way back in the year 2012.

Learned counsel for the State is not in a position to dispute the above fact.

In view of the fact that the requisite payment has already been made by the appellants to the respondent way back in the year 2012 pursuant to the directions given by the learned Single Judge, we are not inclined to interfere in the present appeal.

Hence, the present appeal is dismissed as barred by limitation as well as on merits at this stage.
