The present writ petition has been preferred with the

following prayers:-

“1. By an appropriate Writ, order or direction, the respondent Board may kindly be directed to change the name of the petitioner in his Secondary & Senior Secondary mark-sheet (Annex.1 and 2) and Certificates as well as migration certificate as Jayant Beniwal in place of Kheenya Ram.

Any other appropriate relief which this Hon'ble High Court deems just and proper may kindly be granted in favour of the petitioner.

The cost of the writ petition may kindly be awarded to the petitioner.”

Brief facts of the case are that the petitioner passed the Secondary School Examination in the year 2016 and Senior Secondary School Examination in the year 2018, wherein, his name was Keenya Ram S/o Gula Ram, the petitioner was desirous to change his name from Keenya Ram to Jayant Beniwal. The petitioner got the same published in the daily newspaper and

thereafter, the same was published in the Gazette notification dated 02.03.2023 after depositing the requisite fee.

The petitioner thereafter, applied for changing his name in the Aadhar Card, which was duly changed by the competent authority, the petitioner also got his name changed in the Driving License, Pan Card and Caste Certificate on the basis of Gazette Notification dated 02.03.2023. The petitioner then submitted application to the respondent – Rajasthan Board Of Secondary Education for changing his name in the mark-sheets of Secondary and Senior Secondary Examination as well as migration certificate. 4. The respondent - Rajasthan Board Of Secondary Education, however, did not act upon the application submitted by the petitioner, the petitioner being aggrieved of the same, preferred the present writ petition.

Learned counsel for the parties jointly submit that the matter is squarely covered by order passed by this Court in SBCWP No.17110/2017: Rishika Kumawat Vs. The Secretary & Ors. , decided on 17.07.2023, wherein, it was held as under:-

“11. For the reasons mentioned above, the present writ petition is allowed and the respondent No.1Board is directed to issue fresh mark sheet in favour of petitioner of Class VIII^th , X^th and XII^th while mentioning her name as ‘Rishika Kumawat’ instead of ‘Raju’.

The petitioner is directed to submit fresh application before Board of Secondary Education for changing her name along with the Gazette notification and the copy of the publication of the news in the daily newspaper and the prescribed fees, if any, within a period of fifteen days from today.

The respondent-Board is directed to process the same as early as possible and issue mark sheet in favour of the petitioner for Class VIII^th , X^th and XII^th with the changed name i.e. Rishika Kumawat within a

period of two months from the date of receipt of certified copy of this order.”

In view of the order dated 17.07.2023 passed by this Court, the present writ petition deserves to be allowed and the respondent – Board is directed to issue fresh mark-sheets in favour of the petitioner for Secondary, Senior Secondary as well as Migration Certificate while reflecting his name as ‘Jayant Beniwal’ in place of ‘Keenya Ram’.

The petitioner is directed to submit fresh application before Board of Secondary Education, Ajmer for changing his name along with the Gazette notification and the copy of the publication of the news in the daily newspaper and the prescribed fee, if any, within a period of fifteen days from today.

The respondent – Board is directed to process the same as early as possible and issue Secondary, Senior Secondary marksheets as well as Migration Certificate in favour of the petitioner within a period of two months from the date of receipt of certified copy of this order.

Stay petition and all other pending applications, if any, are disposed of.
