In the instant bunch of petitions, it is submitted that the respondent-RPSC had issued an advertisement dated 27.11.2021 for recruitment on 337 posts in 43 specialties.

It is submitted by learned counsel for the petitioners that while counting the vacancies for direct recruitment on the post of Assistant Professor in different Departments, position as on 01.04.2020 was taken and thereafter, requisition was sent to the Commission.

A dispute has been raised by the petitioners claiming the filling up of the backlog vacancies for Scheduled Caste, Scheduled Tribe and calculation of MBC in respect of 14 Departments/subjects notified in the advertisement dated 27.11.2021. It is submitted by learned counsel for the parties that no dispute has been raised with regard to the vacancies of SC and ST categories, in respect of the Departments other than the 14 specified in the list in question. The submission showing number of departments with the vacancies notified vis a vis , the claim made in the writ petition is already on record.

When the matter was argued, learned Advocate General, under instructions from the respective Department, submitted that to resolve the dispute, an in-house exercise was carried out and after considering the matter vide Schedule-A and Schedule-B, qua the 14 departments backlog was calculated. As per Schedule-A, it was reflected that no backlog as on date exists and whatever was advertised holds the field. Qua Schedule-B which was filed by way of additional submissions, it was submitted that modified requirements will be duly sent to the RPSC qua the backlog which is admitted on part of the respondent-State. Learned Advocate General has submitted that in the light of the above, in petition No. 1777/2022 and 5305/2022, the lis in question will be settled and nothing will survive, with the exception for the other 9

petitioners in SBCWP No. 1777/2022 and SBCWP No. 4027/2022. It is submitted that other than the above-said 9 petitioners, petitioners can file their representation within a period of 7 days. It is further submitted that if aggrieved petitioners will file a representation within a period of 7 days from today before the Additional Chief Secretary (Medical and Health), then the same will be considered by way of speaking order after grant of personal hearing to them within a period of four weeks thereafter.

In light of the exercise undertaken by respondents as per Schedule-B and the modification qua the backlog as calculated, it is spelled by this Court that the grievance in question no more longer exists.

In light of the above said submissions, present petitions are disposed of. Pending application(s), if any, also stand disposed of.

It is made clear that respondents shall carry out the selection procedure in light of the above said submissions. Liberty is given to the petitioners, who are filing representations, that if their dispute is not resolved, they can approach this court again in the future, in accordance with law.
