After arguing to some extent learned counsel for the petitioner seeks withdrawal of the petition while seeking altruistic approach towards protection of his right.

Accordingly, the instant misc. petition is dismissed as withdrawn. Stay petition stands dismissed.

It is directed that during the course of the investigation the petitioner shall not be arrested and in the event of filing of the

charge-sheet, the petitioner shall be directed to appear before the Court concerned where the charge-sheet would be submitted.

In the event of filing of the charge-sheet, the petitioner would be at liberty to file a bail application under Section 437 of the Cr.P.C. before concerned Magistrate.

Upon their appearance and moving a regular bail application, the learned Magistrate shall release them on bail on the very same day on the amount of surety and bonds as he deems fit.
