A perusal of the FIR is disclosing that since there was a direct allegation of commission of a cognizable offence, house breaking and thrashing up of the victim, in my view, the matter is required to be investigated by the Investigating Agency.

While exercising the power under Section 482 of the Cr.P.C., this Court is not expected to embark upon an inquiry so as to examine the genuineness and truthfulness of the allegation. It is a task to be undertaken by the Agency. The investigation conducted so far is revealing that the offence has been found proved under Section 341 and 323 of the IPC and the charge-sheet has been submitted in the Court of

ACJM, No.1, Balotra on 24.04.2023. Thus, nothing survives in this petition for consideration.

Accordingly, the instant misc. petition is dismissed.

The stay petition also stands dismissed.

In the interest of justice, it is directed to the petitioner to appear before the learned trial Court on or before 22.03.2024 and to move a regular bail application.

Upon the appearance of the petitioner, he shall move a regular bail application under Section 437 of the Cr.P.C. before the learned trial Court and whereupon the learned trial Court shall release him on bail on the very same day; on the amount of surety and bond as it deems fit.
