Pawan Kumar Soni S/O Ramjilal Soni, Vs State of Rajasthan

Learned counsel appearing for the petitioner has fairly admitted that remedy available with him is only to file appeal under Section 14(A) of SC/ST against the order of cognizance passed by learned trial court. He submits that under the wrong notion, he has filed this petition before this Court, which is not maintainable.

In these circumstances, learned counsel for the petitioner has prayed that he may be permitted to pursue lawful remedy available to him in accordance with the provisions of law. He further submits that he shall file an appeal under Section 14(A) of SC/ST Act along with application for condonation of delay on the ground that under mistaken notion, remedy was pursued before this Court where it was not maintainable.

Considering the aforesaid submissions made by learned counsel for the petitioner, permission to withdraw this petition with aforesaid liberty is granted.

Accordingly, the instant misc. petition is dismissed with liberty as prayed for. Needless to say, the petitioner can always pursue lawful remedy available to him in accordance with provisions of law.
