Apprehending his arrest in connection with FIR No.181/2024 registered at Police Station Jawahar Nagar (Kota City), District Kota City for the offences under Sections 323, 341, 34 & 307 IPC.

Learned counsel for the accused-petitioner submits that the petitioner who is a juvenile has falsely been implicated in this case. Learned counsel further submits that the injured witness, namely, Vaibhav Yadav in his statement recorded under Section 164 Cr.P.C. has denied to identify the persons who have inflicted the injury. Learned counsel further submits that the injuries sustained by the injured witness-Vaibhav Yadav are of simple in nature. Learned counsel also submits that the petitioner is preparing for IIT and he is an intelligent student having secured 92% marks in the Indian Certificate of Secondary Education

(Class-X) year 2023, therefore, he may be extended the benefit of anticipatory bail.

Learned Public Prosecutor vehemently opposed the anticipatory bail application.

Having considered the statements of the injured witnessVaibhav Yadav and the allegations therein so also the nature of injuries sustained by him, this Court without expressing any opinion on the merits/demerits of the case, deems just and proper to extend the anticipatory bail to the accused-petitioner.

Accordingly, the anticipatory bail application under Section 482 of the B.N.S.S. is allowed and it is ordered that in the event of arrest of the petitioner named above in connection with FIR No.181/2024 registered at Police Station Jawahar Nagar (Kota City), District Kota City shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties in the sum of Rs.50,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without previous permission of the court.
