This bail application has been filed by the accused petitioner u/S 483 BNSS in connection with FIR No. 3/2024 registered at Cyber Police Station Dholpur, District Dholpur for offences under Section 420, 406 IPC and Section 66D of IT Act.

Heard learned counsel for the petitioner as well as the Public Prosecutor.

Learned counsel for the accused petitioner submits that the accused petitioner is an innocent person and he has been involved in this case because of some transaction of money by the complainant in his bank account on initiation of co-accused. He further submits that Rs.1,70,000/- has been credited in the account of the accused petitioner from the account of the complainant and the accused petitioner is ready to pay the same

to the complainant. He further submits that he has brought the demand draft bearing No.182846 amounting Rs.1,70,000/- in favour of the complainant to show his bonafides. He further submits that the accused petitioner is in custody since 12.06.2024 and after completion of investigation, the police has submitted charge-sheet in the matter.

Learned Public Prosecutor vehemently opposed the bail application.

The complainant Ramu Dubey is present himself before this Court.

On the directions of this Court, learned counsel for the accused petitioner handed over the demand draft bearing No.182846 amounting Rs.1,70,000/- to the complainant, who is present in the Court.

Taking into consideration the allegations against the accused petitioner so also the fact that after completion of investigation, the police has submitted charge-sheet in the matter and more particularly the fact that the accused petitioner had paid the amount of Rs.1,70,000/- by a demand draft to the complainant in the Court itself, this Court, without expressing any opinion on merits or demerits of this case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the Trial Court with the stipulation that he shall appear before that

Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
