Petitioner has filed this bail application under Section 439 Cr.P.C. arising out of F.I.R. No.50/2023 registered with the Police Station Anta, District Baran for offence under Sections 420, 406 & 120-B IPC and in the order for offence under Sections 420, 406, 467, 468, 471 & 120-B IPC.

Counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this case and he has nothing to do with the alleged offence. Counsel further submits that the Police after completion of investigation has submitted charge-sheet in the matter; the accused-petitioner is in custody since 03.03.2024 and the trial of the case is likely to take considerable time to conclude, therefore, the accused-petitioner may be enlarged on bail.

Learned Public Prosecutor has vehemently opposed the prayer made by counsel for the petitioner.

Considered the submissions made at bar so also perused the challan papers.

Having considered the submissions made by counsel for the petitioner so also the fact that the Police after completion of investigation has submitted charge-sheet in the matter and the accused-petitioner is in custody since 03.03.2024, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

This bail application is, accordingly, allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
