Apprehending their arrest in connection with FIR No.318/2024 registered at Police Station Shivdaspura, District Jaipur City (South) for the offence(s) under Sections 420, 406 and 120B of IPC, the accused-petitioners have preferred these anticipatory bail applications under Section 438 Cr.P.C.

Learned counsel for the accused-petitioners submits that accused-petitioners have falsely been implicated in the case. It is contended that custodial investigation of the petitioners is not required and offences are triable by Magistrate, therefore, anticipatory bail of the accused-petitioners may be allowed.

Learned Public Prosecutor vehemently opposes the anticipatory bail application and submitted the factual report dated 04.08.2024, which is taken on record.

Heard and perused the factual report.

It is alleged against the petitioners that along with other coaccused, they formed a company in the name of Oneness For Investment in Commercial Enterprises & Management Co. LLC and thereafter, assured the complainant and other person that they would get three times return in the invested amount in their company. The factual report shows that petitioners and other persons invested approximately Rs.1,75,85,000/- in the said company and the said amount was not returned to the Depositor after their several requests. Factual report also shows that thereafter, the complainant lodged an FIR and afterwards police tried to nab/call the petitioners and other co-accused but they did not turn up before the Investigating Agency. It is stated in the factual report that complainant and other persons deposited online amount in the account of the company and also deposited cash, the cash receipts were signed by the petitioners. Factual report also shows that petitioners were involved in similar nature of cases which were registered in various States against them. Singh and Randheer Singh filed a Criminal Miscellaneous Petition No.2860/2024 under Section 482 Cr.P.C. before this Court and the same is dismissed vide order dated 14.05.2024, therefore, considering the above facts, I am not inclined to accept the anticipatory bail of the accused-petitioners.

Accordingly, the anticipatory bail applications under Section 438 Cr.P.C. of the accused-petitioners are hereby dismissed.
