The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.01/2024 registered at Police Station Pahari, District Deeg for the offence(s) under Sections 3, 4, 5 and 8 of R.B.A. Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in the case under Sections 3, 4 and 5/8 of R.B.A. Act. The accused-petitioner is in judicial custody since long and the trial of the case will take sufÏciently long time. Therefore, the benefit of grant of bail may be granted to the accused-petitioner.

Per contra, learned GA-cum-AAG opposes the grant of bail application and submits that from the possession of the accusedpetitioner, 50 Kgs. of Beef was recovered, therefore, considering

the gravity of offence, the bail application of accused-petitioner may be dismissed.

Without commenting anything on the merits of the case and taking into consideration that accused-petitioner is in custody since long and the trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Afsar S/o Ibrahim in connection with FIR No.01/2024 registered at Police Station Pahari, District Deeg shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
