The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.147/2016 registered at Police Station Mantown, District Sawai Madhopur for the offence(s) under Sections 323, 341, 307 and 143 of I.P.C.

Learned counsel for the accused-petitioner submits that the accused-petitioner could not appear before the learned trial court due to his illness. He also submits that accused-petitioner is ready and willing to submit solvent surety to the satisfaction of the learned trial court. The accused petitioner is in judicial custody for almost six months and the trial of the case will take sufÏciently long time. Therefore, the benefit of grant of bail may be granted to the accused-petitioner.

Per contra, learned GA-cum-AAG opposes the grant of bail application.

Considering the fact that accused-petitioner is in custody for almost six months and the trial of case may take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Saddam @ Bihari S/o Mahir Ali in connection with FIR No.147/2016 registered at Police Station Mantown, District Sawai Madhopur shall be enlarged on bail, subject to the condition that the accused-petitioner deposit the amount as per the order of the learned trial Court under the proceedings initiated under Section 446 of the Cr.P.C. against him and also furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
