The instant bail applications have been filed under Section 439 Cr.P.C. on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 409/2023 registered at Police Station Kotwali, District Bundi for the offences under Sections 143, 341, 323, 307 & 452 of IPC.

Learned counsel for the petitioners submits that the accusedpetitioners have been falsely implicated in the case. He further submits that in the FIR, names of the petitioners are not mentioned. The FIR also narrates that other co-accused namely Narendra Gurjar, Banty Gurjar & Prahlad Gurjar caused injuries with sword at injured Jodhraj Singh and at her wife. He further submits that there is no specific allegations against the accusedpetitioners that they caused injuries to injured Jodhraj Singh and Gajju Kamwar. The injuries sustained to injured Verendra Singh were found to be simple blunt in nature. The presence of the accused-petitioners at the place of occurrence is questionable. He further submits that the petitioners are in judicial custody since 19.12.2023. Trial/investigation of the case may take considerable time, therefore, the petitioners may be enlarged on bail.

Per contra, learned Public Prosecutor vehemently opposes the grant of bail applications.

Considering the arguments advanced by the counsel for the parties and looking to the fact that specific allegations for causing injuries to injured Jodhraj Singh and Gajju Kamwar are against the other co-accused Narendra Gurjar, Banty Gurjar & Prahlad Gurjar, so also, the injuries sustained to other injured Verendra Singh were found to be simple blunt in nature, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the accused-petitioners Manish Kumar S/o Chandra Singh and Ramsahaya S/o Lekhchand in connection with FIR No. 409/2023 registered at Police Station

Kotwali, District Bundi shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
