The petitioner has filed this bail application under Section 483 of BNSS in FIR No. 54/2024 registered at Police Station Rawajna Doongar, District Sawai Madhopur u/s 363, 366, 344, 376(3) IPC and Section 5/6 of the POCSO Act.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioner submits that as per the statement recorded before the trial Court, the victim in her crossexamination narrated that she has given the statement before the learned Magistrate under pressure of his family members. She has gone with the accused with her own will. His family members have falsely implicated the accused petitioner. Learned counsel for the petitioner contended that as per the medical report, there is no injury on private parts of the victim. The victim is around 16

years old and accused is about 20 years old. Learned counsel for the petitioner further submits that trial of the case will take considerable time, therefore, the petitioner may be released on bail.

Learned Public Prosecutor has vehemently opposed the bail application.

On consideration of the rival submissions and material available on record and deliberating all the facts and circumstances of the case and without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Ravi Kumar S/o Meetha Lal, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
