This bail application under Section 439 Cr.P.C. has been filed by petitioner in connection with FIR No.489/2023, registered at Police Station Kotkasim, District Khairthal Tijara wherein he is charged for offences punishable under Sections 143, 341, 323, 307, and 302 of IPC and Section 3/25 of Arms Act (later on, he is charged for offences punishable under Sections 147, 148, 149, 341, 323, 307, 302 and 120-B of IPC).

Learned counsel for the petitioner submits that the allegation of causing fire arm injury upon the deceased and injured person are levelled against the accused-Vicky @ Kartoos. Counsel submits that only presence of the petitioner has been shown at the place of occurrence like the presence of the co-accused Om Prakash to whom indulgence of bail has already been granted by this Court. Counsel submits that as per the statements of the injured eyewitness namely, Naveen and Vikas, the allegation of the causing the injury upon the deceased and the injured are again the main

accused Vicky @ Kartoos. Counsel submits that considering this fact and circumstances of the case, the same indulgence be extended to the petitioner as well. Counsel submits that the petitioner is in custody since the date of his arrest and trial will take its own time to conclude, so indulgence of bail be granted to the petitioner.

Per contra, learned Public Prosecutor opposed the bail application. 4. Considering the arguments put forward by the learned counsel for the petitioner and looking to the fact that allegation of causing fire arm injury has been levelled against the accused Vicky @ Kartoos and only presence of the petitioner has been shown at the place of the occurrence like the co-accused Om Prakash to whom indulgence of bail has already been granted and trial will take its own time to conclude and without expressing any opinion on merits and demerits of the case, I deem it just and appropriate to grant indulgence of bail to the petitioner under Section 439 Cr.P.C.

Accordingly, this bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Sandeep Kumar S/o Vijay Singh arrested in connection with aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
