This bail application under Section 439 Cr.P.C. has been filed by the petitioner in connection with FIR No.489/2023, registered at Police Station Kotkasim, District Khairthal-Tijara wherein he is charged for the offences punishable under Sections 143, 341, 323, 307, 302 of IPC and 3/25 Arms Act.

Learned counsel for the petitioner submits that, as per the statements of the injured eye-witness, namely, Naveen and Vikas, specific overt-act has been assigned to co-accused Yashpal and Raman Kartoos that they used fir arm and caused fir arm injury not only to the deseased, but also to these two eye-witnesses as well. Counsel submits that during the course of investigation, fire arms have been recovered at the instance of the co-accused Vivek alias Kartoos. Counsel submits that no specific act has been assigned to

the petitioner and merely on the basis of presence of the spot, the petitioner has been implicated in this case. Counsel submits that after investigation, charge-sheet has been filed and trial will take its own time to conclude, so indulgence be granted to the petitioner.

Per contra, learned Public Prosecutor as well as the learned counsel for the complainant opposed the arguments raised by the counsel for the petitioner and submitted that the petitioner was involved in the same conspiracy with the co-accused, therefore, the petitioner is not entitled to get the indulgence of bail. 4. Heard and considered the submissions made at Bar and perused the material available on the record. 5. Considering the arguments put forward by the learned counsel for the petitioner and looking to the statements of the injured eye-witness, namely, Vikas and Naveen wherein specific overt-act has been assigned to the co-accused Yashpal and Raman Kartoos who caused fire arm injuries to the deceased as well as to the above two eye-witness and looking to the fact that after investigation, charge-sheet has been filed and the trial will take its own time to conclude and without expressing any opinion on merits and demerits of the case, I deem it just and appropriate to grant indulgence of bail to the petitioner under Section 439 Cr.P.C. 5. Accordingly, this bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Kulwant Singh @ Teetu S/o Ramchandra arrested in connection with aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the
