This bail application under Section 439 Cr.P.C. has been filed by the petitioner in connection with FIR No.1439/2023 registered at Police Station Mansarovar, District Jaipur City (South) wherein he is charged for offences punishable under Sections 419, 420 of IPC and Sections 3 and 10 of the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022 (later on, he is charged for offences punishable under Sections 419, 420, 467, 468, 471 and 120-B of IPC).

Learned counsel for the petitioner submits that the alleged offence is triable by the Court of Judicial Magistrate. Counsel submits that the petitioner is in custody since the

date of his arrest and trial will take its own time to conclude, so indulgence be granted to the petitioner.

Per contra, learned Public Prosecutor opposed the bail application and submitted that the petitioner is involved in the case of similar nature and on earlier occasion also, the petitioner was found involved with the case of similar nature, hence, the petitioner does not deserve any indulgence of bail.

Considering the arguments put forward by the learned counsel for the petitioner and looking to the fact that the alleged offence is triable by the Court of Judicial Magistrate and the petitioner is in custody since the date of his arrest and trial will take its own time to conclude and without expressing any opinion on merits and demerits of the case, I deem it just and appropriate to grant indulgence of bail to the petitioner under Section 439 Cr.P.C.

Accordingly, this bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Ranvindarsingh S/o Shri Jarnelsingh arrested in connection with aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.

In case, the petitioner is found to be involved in the matter/s of similar nature and repeat the same offence in future, the Public Prosecutor would be at liberty to move an

application for cancellation of bail of the petitioner before the
