The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner who is in custody in connection with FIR No.282/2021, Police Station Deachu, District Jodhpur for the offence punishable under Sections 147, 148, 323, 427, 440, 341, 307 & 395 of IPC.

Heard learned senior counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

Learned senior counsel for the petitioner submits that coaccused Ashok has been enlarged on bail by co-ordinate Bench of this Court vide order dated 18.10.2022 and co-accused Bhagirath has been enlarged on bail by this Court vide order dated 14.02.2022. Learned senior counsel further submits that the case of the present petitioner is not distinguishable from the case of the

co-accused persons who have already been released on bail. He, therefore, prays that the petitioner may be enlarged on bail.

The learned Public Prosecutor opposes the bail application but he is unable to distinguish the case of the present petitioner vis-a-vis the case of the co-accused persons who have been enlarged on bail.

I have considered the submissions made at the Bar and have gone through the relevant record of the case.

It is true that the case of the present petitioner is not distinguishable from the cases of co-accused Bhagirath and Ashok, but this Court is also of the view that the petitioner is getting involved in the offences of like nature on umpteen number of occasions.

Consequently, the present bail application is allowed. It is ordered that the accused-petitioner Vishnaram Jangu @ Vihnu Jangu S/o Mohanram arrested in connection with FIR No.282/2021, Police Station Deachu, District Jodhpur, shall be released on bail; provided he furnishes a personal bond of Rs.50,000/- (Rupees: Fifty Thousand Only) with two sureties of Rs.25,000/- (Rupees: Twenty Five Thousand Only) each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.

However, if the petitioner is found involved in any other case after his release on bail in the present case, the benefit of grant of bail shall be considered strictly. It is also ordered that the

petitioner will mark his attendance in the first week of every month at the Police Station of his residence. It is also ordered that if the petitioner is shifting or leaving the city for a longer period then, the same shall be informed to the local SHO of the area of his residence.
