Learned counsel for the petitioner submits that he does not want to press the present bail application filed under Section 439 Cr.P.C. and seeks liberty to file fresh after recording the statement of Seizure/Investigating Officer.
Accordingly, the present bail application is dismissed as not pressed with the liberty, as prayed for. Since the accused petitioner is in custody for a quite long period, therefore, the learned trial Court is directed to record the statement of the said witness(s) within next three months from the date of this order.
