Apprehending his arrest in connection with FIR No.33/2023, registered at Police Station Raithal, District Bundi, for the offence(s) under Section 420 and 406 of IPC, the petitioner has preferred this anticipatory bail application under Section 438 Cr.P.C.

Learned counsel for the accused-petitioner submits that petitioner has falsely been implicated in this case. It is alleged in the FIR that the complainant Ghanshyam handed over his tractor to other co-accused Ashok Kumar and Rawal Meena on monthly rent of Rs.21,000/- per month. The main allegation are against co-accused Ashok Kumar and Rawal Meena, name of the petitioner is not mentioned in the FIR. During course of investigation it was revealed that co-accused Ashok Kumar and Rawal Meena had sold the tractor to Murad Hussain. Murad Hussain has already been enlarged on anticipatory bail by the learned Sessions Judge, Bundi vide order dated 13.07.2023. The petitioner is ready and willing to co-operate with the investigation, therefore, anticipatory bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor vehemently opposes the anticipatory bail application of the accused-petitioner and has submitted the factual report. The main allegation of cheating are against the other co-accused, the other co-accused Ashok Kumar and Rawal Meena had sold the complainant tractor to Murad Hussain.

Considering the above fact, without expressing anything on the merits of the case, I deem it just and proper to allow the anticipatory bail application of the petitioner.

Accordingly, the anticipatory bail application under Section 438 Cr.P.C. is allowed and it is ordered that in the event of arrest of the petitioner- Balram S/o Shri Ummed Singh, in connection with FIR No.33/2023, registered at Police Station Raithal, District Bundi, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without previous permission of the court.
