Apprehending his arrest in connection with FIR No.569/2023 registered at Police Station Bansur, District Kotputli-Behror for the offence(s) under Sections 143, 323, 341, 506 and 308 of IPC, the accused-petitioner has preferred this anticipatory bail application under Section 438 Cr.P.C.

Learned counsel for the accused-petitioner submits that accused-petitioner has falsely been implicated in this case. He further submits that the case under Section 308 of IPC is not made out and the other offences are bailable one. Petitioner is ready and willing to cooperate with the investigation. He further submits that the injuries sustained to injured Prakash & Hawa Singh were found to be simple in nature and there is no injury opined to be dangerous to life. Further, the petitioner and injured have arrived at compromise, therefore, anticipatory bail of the accused-petitioner may be allowed.

Learned Public Prosecutor vehemently opposes the anticipatory bail application.

Heard and perused the case diary.

Considering the fact that the injuries sustained to injured Prakash and Hawa Singh were found to be simple in nature. There is no opinion of the concerned Doctor that injuries sustained to injured Prakash and Hawa Singh are dangerous to life, thus, without commenting anything on the merits of the case, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner.

Accordingly, the anticipatory bail application under Section 438 Cr.P.C. is allowed and it is ordered that in the event of arrest of the petitioner Ramniwas S/o Gheesaram, in connection with FIR No.569/2023 registered at Police Station Bansur, District Kotputli-Behror, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and

¶21

(iii) that the petitioner shall not leave India without previous permission of the court.
