The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioners Sharavan Kumar & Rajendra Prasad. The petitioners have been arrested in connection with FIR No. 367/2023 registered at Police Station Dadiya, District Sikar for the offence under Sections 341, 323, 382 & 506 of IPC.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the case. He further submits that the injuries caused to injured-Manoj Kumar were found to be grievous but not dangerous to life. The two injuries were found at left hand and left forearm of the injured- Manoj Kumar. The injuries caused at scalp were found to be simple blunt.

He further submits that the petitioners are in judicial custody since 18.01.2024 and the trial of the case may take considerable time, therefore, the petitioners may be enlarged on bail.

Per contra, learned Public Prosecutor opposes the grant of bail application.

Considering the arguments advanced by the counsel for the parties and looking to the fact that there is grievous injury at vital part of injured- Manoj Kumar but not dangerous to life and the two injuries were caused to the injured at left hand and left forearm, so also, trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioners Sharavan Kumar S/o Shri Ramchandra & Rajendra Prasad S/o Shri Shaitanram in connection with FIR No.367/2023 registered at Police Station Dadiya, District Sikar shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
