This bail application has been filed by the petitioner under Section 483 of the B.N.S.S. arising out of F.I.R. No.293/2023, registered with the Police Station Peeplu, District Tonk for offences under Sections 8/15 of the Prevention of Illicit Traffic In Narcotic Drugs and Psychotropic Substances Act, 1988.

Learned counsel for the petitioner submits that the petitioner has been implicated in this case on the basis of the statement of co-accused persons. Counsel further submits that the petitioner is in custody since 12.09.2024 and Police after completion of investigation has submitted charge-sheet in the matter. Counsel further submits that some of the co-accused persons have already been released on bail, therefore, the petitioner may be released on bail.

Learned Public Prosecutor appearing for the State opposed the bail application and submits that the petitioner is actively

involved in commission of the alleged offence, therefore, he does not deserve any liberty from this Court.

Considered the submissions made at bar and also perused the challan papers.

Taking into consideration the totality of the facts & circumstances of the case and more particularly the fact that the present petitioner has been implicated in this case only on the basis of the statement of co-accused persons and that too with an allegation for which there is no evidence available on record and also the fact that no other criminal case is pending against the petitioner, this Court without expressing any opinion on merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before the trial Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
