Apprehending the arrest in connection with FIR No.07/2024 registered at Police Station Pachari Kalan, District Jhunjhunu for the offence(s) under Section 332, 353, 379, 504 and 506 of IPC and under Sections 4 and 21 of Mines and Minerals (Development and Regulation) Act, 1957, the petitioner has preferred this anticipatory bail application under Section 438 Cr.P.C.

Learned counsel for the accused-petitioner submits that petitioner has falsely been implicated in the case. Learned counsel for the petitioner also submits that other co-accused Raj Kumar @ Leelu has already been enlarged on anticipatory bail by this Court and case of the accused-petitioner is not distinguishable from the case of co-accused Raj Kumar @ Leelu who has already been enlarged on anticipatory bail. He further submits that the custodial

investigation of the accused petitioner is not required. He prays that the anticipatory bail of accused-petitioner may be allowed. 3. Learned Public Prosecutor vehemently opposes the bail application.

I have considered the overall allegations levelled in the FIR and contentions made by the counsel for the parties.

Considering the fact that the other-accused Raj Kumar @ Leelu has already been enlarged on anticipatory bail and case of the present accused-petitioner is not distinguishable from the case of co-accused Raj Kumar @ Leelu, thus, without expressing anything on merits/ demerits of the case and looking to the fact that custodial investigation of the present petitioner is not required, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner.

Accordingly, the anticipatory bail application under Section 438 Cr.P.C. is allowed and it is ordered that in the event of arrest of the petitioner- Satyaveer S/o Nand Ram, in connection with FIR No.07/2024 registered at Police Station Pachari Kalan, District Jhunjhunu, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- to the satisfaction of the S.H.O/I.O/Arresting OfÏcer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police ofÏcer as and when required;

¶24

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police ofÏcer, and

¶25

(iii) that the petitioner shall not leave India without previous permission of the court.
