This bail application has been filed by the petitioner under Section 483 of the B.N.S.S. arising out of F.I.R. No.225/2024, registered with the Police Station Mozmabad, District Dudu for offences under Section 392 of IPC.

Learned counsel for the petitioner submits that the petitioner has been implicated in this case based on a false and fabricated story. Counsel further submits that the dispute arose between the complainant and the accused party because of overtaking of vehicles. Counsel further submits that no recovery has been effected from the petitioner and he is in custody since 23.06.2024 and is no more required for any kind of interrogation or recovery. Counsel also submits that co-accused persons namely Narendra Singh Meena and Pratap Singh have already been released on bail by this Court vide order dated 23.08.2024, therefore, the petitioner may be released on bail.

Considered the submissions made by learned counsel for the petitioner as well as learned Public Prosecutor.

Having regard to the submissions made by counsel for the petitioner so also the fact that no recovery has been effected from the petitioner and the offence as alleged against him is triable by First Class Magistrate and also the fact that co-accused persons namely Narendra Singh Meena and Pratap Singh have already been enlarged on bail by this Court on 23.08.2024, this Court without expressing any opinion on merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before the trial Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
