The 2^nd bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of accused-petitioner in connection with FIR No.158/2024 registered at Police Station Govindgarh (Alwar), District Alwar for offences under Sections 307 and 504 IPC.

First Bail application of the petitioner bearing S.B. Criminal Misc. Bail Application No.8021/2024 was dismissed as withdrawn vide order dated 23.08.2024 with liberty to file fresh bail application after filing of the charge-sheet.

Learned counsel for the petitioner submits that the Police after completion of investigation has submitted charge-sheet in the present matter. Learned counsel further submits that the

injuries sustained by the complainant are on his right palm and there is no injury on the vital organ. Learned counsel also submits that the petitioner is in custody since 10.06.2024, therefore, he may be released on bail.

Learned Public Prosecutor vehemently opposed the bail application.

Considered the submissions made by learned counsel for the petitioner as well learned Public Prosecutor and also perused the material available on record.

Having considered the allegations levelled against the petitioner and so also the fact that there is no injury on the vital organs of the injured, this Court without expressing any opinion on the merits/demerits of the case, deems just and proper to enlarge the accused-petitioner on bail.

Accordingly, the 2^nd bail application under Section 483 of the B.N.S.S. is allowed and it is ordered that the accused-petitioner named above in connection with FIR No.158/2024 registered at Police Station Govindgarh (Alwar), District Alwar shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
