The instant bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of accused-petitioner in connection with FIR No.359/2024 registered at Police Station Bassi, District Jaipur City (East) for offences under Sections 189(2), 115(2), 126(2) & 352 of the Bharatiya Nyaya Sanhita, 2023.

Learned counsel for the petitioner submits that there are cross-cases between the parties and prior to the alleged incident, the accused party submitted a complaint to the Competent Authority to bound the complainant party to maintain peace. Learned counsel further submits that the injuries sustained by the complainant party are simple in nature. Learned counsel also submits that the petitioner is in custody since 12.08.2024 and is

no more required for any kind of interrogation or recovery, therefore, he may be released on bail.

Learned Public Prosecutor vehemently opposed the bail application. However, the learned Public Prosecutor does not dispute the fact that the complainant party has sustained injuries which are simple in nature. 4. Considered the submissions made by learned counsel for the petitioner as well as learned Public prosecutor and also perused the material available on record.

Having regard the allegations levelled against the petitioner so also the nature of injuries sustained by the complainant party which are simple in nature, this Court without expressing any opinion on the merits/demerits of the case, deems just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 of the B.N.S.S. is allowed and it is ordered that the accused-petitioner named above in connection with FIR No.359/2024 registered at Police Station Bassi, District Jaipur City (East) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
