Learned counsel for the petitioner-institute submits that the respondent-State has issued communication dated 19.07.2023 (Annexure-8) by which the NOC has been granted retrospectively in favour of the petitioner-institute for the purpose of running the B.Sc Nursing Course for 60 seats. He also submits that on account of ACB proceedings initiated against the petitioner-institute, the

respondent has passed an order dated 01.10.2013 (Annexure-3) whereby, the petitioner-institute was banned from taking admission in the B.Sc Nursing Course in the academic session 2013-2014 and further academic session as well.

Learned counsel for the petitioner further submits that by way of an additional affidavit, the communication dated 15.03.2024 has been placed on record which has been issued by the respondent No.2 Rajasthan Nursing Council in which it has been said that the earlier order dated 14.07.2020 has been amended vide order dated 22.02.2024 while permitting the petitioner-college to run the B.Sc Nursing Course for 60 seats and accordingly they have been given the affiliation for 60 seats. The present writ petition has been filed requesting that the petitionerinstitute may be permitted to undertake the B.Sc Nursing course for the academic Session 2023-2024 with the intake capacity of 60 seats. It is seen that the petitioner-institute has been permitted to take the admission for the B.Sc Nursing Course for the academic sessions 2023-2024 with the intake capacity of 40 seats however in the light of subsequent developments the affiliation has been given to the petitioner-institute for running the B.Sc Nursing Course for intake capacity of 60 seats vide communications dated 15.03.2024 and 19.07.2023 (Annexure-8), therefore, the learned counsel for the petitioner requests that the petitioner-institute may be permitted to take admission on additional 20 seats for the academic session 2023-2024.

Thus, in view of the submissions made and particularly looking to the fact that the State Government vide communication dated 19.07.2023 (Annexure-8) and the Rajasthan Nursing

Council, Jaipur vide communication dated 15.03.2024 have granted affiliation to the petitioner-institute with retrospective effect for intake of students for 60 seats in the B.Sc Nursing Course, hence, the present writ petition is disposed of with the direction to the respondents to permit the petitioner-institute to give admission on additional 20 seats for academic session 20232024 in the B.Sc Nursing Course.

The petitioner-institution further directed to pay due fees, if any, for taking admission of the students of additional 20 seats in academic session 2023-2024.
