It is informed by learned Deputy Government Advocate that the victim has been intimated about filing of the appeal as well as suspension of sentence application.

A report in this regard is submitted by Deputy Government Advocate, the same is taken on record.

No one has put in appearance on behalf of the victim.

It is contended by learned counsel for the applicant that applicant has remained in custody for a period of more than 6 years. The dispute took place on the spur of moment and the same pertained to wheat flour. It is argued that majority of

witnesses have turned hostile; disposal of appeal is bound to take time.

Learned Deputy Government Advocate has opposed the application for suspension of sentence.

We have considered the contentions.

Taking note of the custody period as well as the fact that the incident took place on the spur of moment when the accused spread the wheat flour, provided by the deceased, we deem it proper to allow the application for suspension of sentence.

Accordingly, the application for suspension of sentence is allowed. It is ordered that the sentence awarded to accused-applicant in Sessions Case No.76/2017 (CIS No.76/2017), shall remain suspended if the accused-applicant furnishes a personal bond of Rs.1,00,000/- and two sureties of Rs.50,000/-each to the satisfaction of the learned Trial Court to the effect that he shall appear before this Court as and when called upon to do so.
