After suspension of sentence of the appellant-applicant in the year 2013, he regularly appeared before the trial court for marking his presence in the month of January every year, however in 2020, he has failed to appear before the trial court for marking his presence and the trial court has informed this Court about the same. Considering the same, this Court has granted some time to police to trace out the appellant-applicant, however, when the police failed to trace him out, then on 01.05.2023, his bail bonds were forfeited and a warrant of arrest was issued against him. Pursuant to the warrant of arrest, the police arrested the appellant-applicant and he was sent to jail vide order dated 14.08.2023. Learned counsel for the appellant-applicant has submitted as the appellant-applicant is a labour and as he went to Uttarakhand for earning his livelihood, therefore, he has failed to appear before the trial court in the month of January 2020. Learned counsel has further submitted that after January 2020, the appellant-applicant has not appeared before the trial court or this Court and the police arrested him as he remained in Uttarakhand in that period. Learned counsel has further submitted that the appellant-applicant undertakes to abide by all the conditions imposed by this Court in future. It is, therefore, prayed
