Learned counsel for the respondents has submitted that the refund of the petitioner, was withheld by the Income Tax Department regarding calculation of interest, in view of the fact that demand was pending against the petitioner, however later on, the respondent-Income Tax Department has rectified the order and released the refund in favour of the petitioner as per her claim vide Annexure-R/1 annexed with the reply to the writ petition.
No counter reply has been filed on behalf of the petitioner Hence, in view of the submissions made by learned counsel for the respondents, this writ petition is dismissed as having become infructuous with liberty to the petitioner to avail appropriate remedy in accordance with law, if occasion so arises.
