This contempt petition is filed by the petitioner alleging that the respondents are not complying with the directions given by this Court vide order dated 02.09.2022 while disposing SBCWP No.12530/2022.
This Court on 02.09.2022 has directed the PLPC concerned to conduct a thorough enquiry into the representation in the light of the directions given by this Court in the case of Jagdish Prasad Meena and Ors. vs. State of Rajasthan passed in D.B. Civil Writ Petition (PIL) No.10819/2018 decided on 30.01.2019 within a period of six months from the date of submission of the representation.
Reply/compliance report is filed on behalf of the respondents, wherein it is mentioned that the respondent-PLPC

has considered all the representations filed by the petitioner and found that as many as 18 encroachments are there on the public land of Khasra Nos.95 and 106 of village Amarpura Raneri, Tehsil Bap Distt. Jodhpur proceedings against the encroachers have already been initiated under Section 91 of the Rajasthan Land Revenue Act and conviction orders have already been passed.
The Revenue Authorities have also constituted a team to remove the alleged encroachments and police aid has also been asked for the same.
Counter to the compliance report is filed by learned counsel for the petitioner. Learned counsel for the petitioner has submitted a report, wherein it is alleged that till date, the encroachments made over the public land falling in Khasra Nos.95 and 106 of village Amarpura Raneri, Tehsil Bap Distt. Jodhpur have not been removed by the respondents.
Learned AAG has submitted that since model code of conduct was in effect till 05.12.2023 and the officials were in election duty, the encroachments have not been removed, however now, when the model code of conduct is lifted, the encroachments will be removed expeditiously.
In view of the above, we are of the view that no further order is required to be passed by this Court in this writ contempt petition and the same is disposed of.
