Mr. Khileree, learned counsel for the petitioner informs that during the pendency of writ petition, by way of order dated 16.05.2022, the respondents have offered appointment to the petitioner and he has joined the services. He concedes that in principle, the matter has been rendered infructuous.

He however submits that the petitioner ought to have been given appointment (notionally with effect from 24.03.2022), when the person less meritorious than the petitioner was offered appointment.

Considering that the basic issue as to whether certificate of N.P.C.D.C.S. is valid or not is subject matter of writ petition filed by Disha Rani ( S.B. Civil Writ Petition No.1330/2022 ), this Court does not deem it appropriate to pass any order regarding date of effectiveness of petitioner’s appointment.

The petitioner may file representation before the competent authority for claiming notional benefits, who shall consider the same in accordance with law.

The petition stands disposed of with the aforesaid clarifications.

The stay application also stands disposed of accordingly.
