The petitioners being wife and husband in their respective writ petitions, have challenged the order dated 20.12.2022, whereby they have been transferred from District Alwar to Bharatpur.

Learned counsel for the petitioners has submitted that transfer of the persons against whom the petitioners were transferred has been cancelled by the State Government and, therefore, purported administrative exigency to transfer the petitioners does not continue.

Without interfering in the present writ petitions, the petitioners are permitted to file a representation before the competent authority of the State Government highlighting the fact that transfer order of persons namely Avinash Sharma and Munesh Yadav, against whom the petitioners were transferred, has been cancelled.

In case, any representation is so addressed by the petitioners, the competent authority of the State Government shall consider the same objectively, particularly in view of the fact that transfer order of persons namely Avinash Sharma and Munesh Yadav has been cancelled by the State Government.

¶30

The competent authority shall consider the representation submitted by the petitioners in accordance with law, as expeditiously as possible, preferably within a period of two weeks of receiving the representation.

With the directions aforesaid, both the writ petitions are disposed of.

Stay applications also stand disposed of.
