Heard learned counsel for the parties.

The present writ petition has been filed for the following

relief:-

“(i)By an appropriate writ order or direction in the nature therein thereby to quash and set aside the impugned transfer order dated 12.01.2023 (Ann.3) issued by the respondent No.2 holding the same as illegal and unjustified and respondents may kindly be directed to allow the petitioner for performing his duty in his previous posting place i.e. Government Senior Secondary School 15 O, Sri Ganganagar in the larger interest of justice”.

The counsel for the respondents submits that in view of the order dated 23.08.2022, the transfer of the petitioner cannot be said to be arbitrary and illegal.

Learned counsel for the petitioner does not want to press the relief sought for in the present writ petition. However, he prays that in the impugned transfer order dated 12.01.2023, it has been incorrectly mentioned that the petitioner made a request for this transfer whereas no such request was ever made by the petitioner. Therefore, the transfer order may be maintained and the respondents may be directed to pay TA/DA to the petitioner for undertaking his transfer.

In view of the limited prayer made by the counsel for the petitioner, the present writ petition is disposed of with a direction to the respondents to pay TA/DA to the petitioner in accordance with the rules in pursuance of the order dated 12.01.2023.
