This writ petition has been filed by the petitioner with the

following prayer:-

“It is, therefore, humbly prayed that your lordships may very graciously be pleased to issue a writ of mandamus or any other appropriate writ, order or direction.

To direct Respondent No. 2 to issue NOC in pursuance of NOC dt. 30/10/2017 Annexure -2 and allowed admission to the petitioner further direct the Respondent No. 2 to approve NOC and allow admission in SP Medical college Bikaner in 2^nd year MBBS course.

Further Communication issued vide letter dated 27/11/2017 Annexure-9. And proceedings issued vide covering letter dt.

20/12/2018 Annexure-6, and letter dt. 31/12/2018 Annexure-8, be declared illegal quashed and set aside.

Further respondent be directed to allow the petitioner to complete her internship at SP Medical college Bikaner. That any other appropriate writ order or direction which this Hon’bale court ma deemed just and proper in the facts and circumstances may kindly be passed in favour of the petitioner.”

On 13.03.2023, this court passed the following order:“None present on behalf of the petitioner. However, in the interest of justice, list this matter again on 22.03.2023.”

Today also none appeared on behalf of the petitioner.

By way of this writ petition, the petitioner has sought transfer from NC College, Panipat to S.P. Medical College, Bikaner.

Counsel for the respondents submitted that according to the Clause-6 of the Graduate Medical Education Regulations, 1997 (hereinafter to be referred as ‘Regulations 1997’) the migration from one medical college to another medical college is permissible with the NOC of both the colleges and the students has to submit application for migration within a period of one month of the passing of first professional MBBS examination whereas, the petitioner filed this writ petition in the year 2019 when she was student of 3^rd year Medical course, therefore, she is not entitled for any relief form this court.

Heard counsel for the respondents and perused the record as well as Regulations of 1997 regarding migration from one medical college to another medical college.

Considering the facts and circumstances of the present case, in my view, no case is made out for interference by this court under Article 226 of the Constitution of India as the petitioner failed to apply for migration within the time stipulated in the Regulations of 1997.

In that view of the matter, this writ petition stands dismissed.
